Dedicated Email Terms

AGREEMENT TO TERMS

These Dedicated Email Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client”) and White Bull Media ("Company", “we”, “us”, or “our”), concerning your engagement with us for dedicated email blasts through any of our publishing partners. By engaging our services, the Client acknowledges having read, understood, and agreed to be bound by all of these Dedicated Email Terms.

CLIENT OBLIGATIONS

Clients are required to provide all necessary materials for the email blast. This includes subject line, ad/copy, images, text with links, or an HTML file. White Bull Media reserves the right to request modifications to the provided creatives or decline them if deemed inappropriate for our audience. In such cases, the offer can be replaced upon approval. Prohibited content includes, but is not limited to, illegal or adult content.

PAYMENT TERMS

Pricing is determined on an individual basis, predicated on CPM (Cost Per Thousand Impressions), which reflects the audience size. Accepted payment methods are ACH deposit, wire transfer, and for established clients, credit cards. The credit card payments attract a surcharge of 3%.

LIABILITIES AND INDEMNITIES

White Bull Media, in its capacity as a service provider, assumes no responsibility or liability for the products, services, or content promoted through the email blasts. The Client hereby indemnifies and holds White Bull Media harmless against any claims, damages, or liabilities arising out of the content provided by the Client for the email blast.

SERVICE INTERRUPTIONS

In the unforeseen event of delays, interruptions, or any impediments, the email blast will be rescheduled to a mutually agreeable later date. Both parties acknowledge that certain circumstances beyond control may affect the timely delivery of services.

INTELLECTUAL PROPERTY

The Client retains all proprietary rights to the content they provide. White Bull Media is granted a limited, non-exclusive license to use the content solely for the purpose of the dedicated email blast. The Client warrants that the provided content does not infringe upon third-party rights and indemnifies White Bull Media against any claims arising from such infringements.

GOVERNING LAW

This agreement and any disputes arising therefrom shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of law principles.
